Briefing / NHS charities and public benefit (England and Wales)
For an organisation to be charitable it must have only charitable purposes that are for the ‘public benefit’. If this is not the case, the organisation is not a charity. Trustees must also follow Charity Commission guidance and demonstrate that they have taken it into account.
For NHS charities there are a number of issues that require particular attention – this briefing runs through each in turn and includes an example approach to decision making.
